Qualification Requirements

  • valid business license
    Bidder has to submit valid business license indicating the stream of business in which the Bidder is engaged, in accordance with ITB Clause 4.5(b)(i);

  • Beneficial Ownership Disclosure Form
    In case of Partnerships, Consortium or Joint Ventures, the bidder submit a separate Beneficial Ownership Disclosure Form for each member; disclose at least one of the following: –
    1)    Directly or indirectly holding 10% or more of the shares.
    2)    Directly or indirectly holding 10% or more of the Voting Rights or
    3)    Directly or indirectly having the right to appoint a majority of the board of Directors or an equivalent governing body of the consultant or
    4)    Whether a person directly or indirectly exercises significant influence or control over the Company (tendered)

  • JV agreement
     In the case of a bid submitted by a Partnership, Consortium or a joint venture (JV), the Bidder has to submit the Form Data on Partnership, Consortium or Joint Ventures, the Agreement governing the formation of joint venture, or letter of intent to form Partnership, Consortium or Joint Venture, including a draft agreement, in accordance with ITB Clause 4.1.

Terms and Conditions

General Requirements (Applicable to All Protocols) All bidders must meet the following requirements to qualify for technical evaluation: 1. Personnel Certification: All qualification activities must be performed by trained and certified personnel from ISO-accredited and traceable certification bodies. 2. Instrument Traceability: All measuring instruments and tools must be calibrated, tested, and traceable to international standards. 3. Calibration Documentation: Valid calibration certificates for each instrument or tool must be included during qualification and in the final implementation report. 4. Regulatory Compliance: All protocols, raw data, deviations, and reports must comply with EFDA, WHO GMP, and ISO 14644 requirements. 5. Protocol Submission: Bidders must submit all required HVAC Qualification Protocol Documents as part of their bid. 6. Company Accreditation: Bidders must provide an ISO 17025–traceable HVAC qualification certificate (or equivalent) for the company performing the HVAC qualification work. 7. Professional Certification: Bidders must submit the professional qualification certificate of the HVAC/electromechanical engineer assigned to this project. 8. Qualified Installation: The bidder must perform all installations using highly qualified, trained, and certified personnel. Terms and Conditions 1 Eligibility: Bidders must be eligible firms under the Federal Democratic Republic of Ethiopia Procurement Law and must not be debarred or suspended. 2 Bid Validity: All bids must remain valid for the period specified in the bidding document, starting from the date of submission. 3 Fixed Contract Price: The contract price is fixed and must cover all costs, including taxes, labor, materials, equipment, and transportation. 4 Technical Evaluation: Only bids meeting the minimum technical specifications and requirements will be considered responsive. The contract will be awarded to the technically compliant bidder offering the lowest evaluated price. 5 Bill of Quantities (BOQ): Bidders must complete the BOQ exactly as provided in the Technical Specifications. Any deviation may result in rejection. 6 Subcontracting: Allowed only with prior written approval from EFDA. 7 Completion Period: All works must be completed within 30 calendar days from site handover. A commitment letter confirming this timeline must be submitted. Delays may result in liquidated damages or contract termination. 8 Mobilization: The awarded bidder must mobilize personnel and equipment within three (3) calendar days after site handover. 9 Payment term: Payment shall be made upon full completion, installation, and commissioning of the works, following formal inspection and acceptance by authorized EFDA personnel 10 Bid Security: A hard copy of the bid security uploaded to the EGP system must be submitted within 24 hours of bid opening. 11 Private Key Submission: Bidders must provide the private key to the EGP system within 24 hours of bid opening. 12 Anti-Bribery Compliance: Bidders must complete and submit the Anti-Bribery Pledge Form included in the Specific Requirements section. 13 Alternative Proposals: Not permitted. 14 Termination: The Employer reserves the right to terminate the contract in cases of non-performance or breach. 15 Dispute Resolution: Disputes must first be resolved amicably; if unresolved, they will be referred to arbitration as specified in the contract. 16 Governing Law: The contract will be governed by the laws of the Federal Democratic Republic of Ethiopia. 17 Additional Requirements: Other conditions are detailed in the hard copy bidding document provided in the Specific Requirements section. 18 Right to Cancel: The Public Body reserves the right to cancel the bid process, in whole or in part, at any time before contract award.
